Due to a hung jury, the $25 million Ethereum MEV case has been declared a mistrial.

On November 8th, as per the report by Cointelegraph, the New York Federal Court declared a mistrial in the case involving the two brothers Anton and James Peraire-Bueno. This was because the jury was unable to reach a unanimous decision regarding guilt or innocence. The two were accused in relation to a 2023 Ethereum chain MEV attack that managed to obtain approximately $25 million within about 12 seconds. The prosecution claimed that their actions constituted a "bait and switch" and involved fraud and money laundering. On the other hand, the defense argued that such transactions were more similar to on-chain "front-running" in a game-like behavior. The case, which lasted for three weeks, ultimately ended in a mistrial due to the split opinions among the jury.
