Following the SEC, the CFTC has rolled out favorable crypto policies, relaxing registration requirements for "passive software" to boost crypto market development and innovation.

U.S. Commodity Futures Trading Commission (CFTC) announced that its Division of Market Participants has issued a no-action letter to providers of "passive software". Under specific conditions—where the software only assists users in trading with regulated futures commission merchants, introducing brokers, or designated contract markets—CFTC staff will not recommend enforcement action against providers that are not registered as introducing brokers or their affiliates. Eligible platforms may not hold user assets or make trading decisions on users’ behalf. This measure expands the case arrangement from March this year targeting the crypto wallet Phantom to qualifying software providers. Industry insiders believe this could make it easier for crypto wallets, websites, and other online platforms to access regulated prediction markets and other CFTC-supervised products. The guidance is viewed as favorable for the development and innovation of crypto market tools.
